Legal Requirements
A Marriage License in Florida is issued by a
county court judge or a clerk of the circuit court.
Requirements:
*The couple must apply in person to the Clerk's Marriage License
Department.
*The Clerk's Department requires a driver's license, valid passport or State or
military identification for both parties.
*Social security number, valid passport number or immigration number
*Date last marriage ended (divorce or death), if applicable.
Fee
The fee is $97.50 payable by cash or money order, some counties accept Visa and
MasterCard.
Personal checks are not accepted.
Florida Residents
A 3 day waiting period is required unless both parties completed a state
sanctioned marriage preparation course within the last 12 months. Completion of
this course entitles the couple to a discount of $32.50, making the fee $61.00.
Out of State Residents
The license is immediately valid after application is filed. The waiting period
is not required.
One Florida Resident, One Out of State Resident
The 3 day waiting period applies if the Florida resident has not completed the
marriage preparation course.
Blood tests are NOT required in the State of Florida
Additional Information
The marriage license must be used within 60 days of issuance of the license.
The license may be used in any county in the State of Florida.
License should be returned within 10 days after the wedding by the officiant.
The couple should receive their copy of the license 14 days after the wedding.
